<p>COMMENTS:</p>
<p>The growing list of senior law enforcement officials facing arrest, investigation or criminal allegations paints a deeply troubling picture for South Africa’s policing and criminal justice structures.</p>
<p>Many of these cases involve allegations linked to corruption, organised crime, precious metals syndicates and abuse of state resources and interference in investigations.</p>
<p>The arrests have intensified public concern over the extent to which criminal networks may have infiltrated sections of law enforcement agencies.</p>
<p>While arrests do not amount to guilt and all accused remain innocent until proven guilty in court, the repeated implication of senior-ranking officials continues to erode public trust in institutions tasked with fighting crime and corruption.</p>
<p>The developments also place renewed focus on the work of oversight bodies and commissions investigating corruption and political interference within the criminal justice system.</p>
<p>Sources say more arrests are likely over the coming weeks.</p>

										<content:encoded><![CDATA[<article class="richtext prose text-base font-medium lg:text-lg space-y-4" data-v-da53ba10="">Parliament has been ordered to begin an impeachment inquiry against President Cyril Ramaphosa.This, after the Constitutional Court ruled that it acted irrationally by not adopting a report that found he may have violated his oath of office regarding his actions in response to the burglary at his Phala Phala farm.</p>
<p>The Section 89 report, which was tabled before Parliament in December 2022, found Ramaphosa may have violated his oath of office and the Prevention and Combating of Corrupt Activities Act.</p>
<p>However, the report was not adopted by Parliament, with the African National Congress (ANC) using its majority in the house to vote against it.</p>
<p>The Constitutional Court said the vote was unconstitutional and has set it aside.</p>
<p>Chief Justice Mandisa Maya handed down the ruling.</p>
<p>“It is declared that the vote of the National Assembly taken on 13 December 2022, declining to refer the report to the independent panel to an impeachment committee as envisaged in the NA [National Assembly] rules, is inconsistent with the Constitution, invalid and it is set aside. The report of the independent panel is referred to the impeachment committee established in terms of the NA rules&#8230;”</p>

<article class="richtext prose text-base font-medium lg:text-lg space-y-4" data-v-da53ba10="">Meanwhile, a small group of Economic Freedom Fighters (EFF) supporters celebrated outside the Constitutional Court following its ruling.The case was brought by the EFF and the African Transformation Movement (ATM), arguing that Parliament failed to hold the president accountable after a Section 89 panel found that he may have breached his oath of office.</p>
<p>EFF supporters picketed outside the Constitutional Court as it handed down a judgment on the party’s court action on Parliament’s handling of the Phala Phala scandal.</p>
<p>The supporters broke out in song and chants after the landmark ruling.</p>
<p>The party had set up a large jumbo screen and a stage outside the apex court, where its leaders were expected to address supporters shortly.</p>
<p>In November 2024, the EFF argued that its preferred outcome was for the apex court to refer the matter back to Parliament.</p>

										<content:encoded><![CDATA[<p>Farmers were fuming after Minister of Agriculture John Steenhuisen was given yet another extended deadline to submit the department’s plan of action to combat foot-and-mouth disease (FMD).</p>
<p>This comes after the urgent proceedings were postponed for a second time because the department wasn’t ready to proceed.</p>
<h2 id="h-high-court-reluctantly-postponed-case-again" class="wp-block-heading">High Court reluctantly postponed case again</h2>
<p>Last week, the High Court in Pretoria reluctantly granted the postponement to enable Steenhuisen more time to publish a vaccination scheme under Section 10 of the Animal Diseases Act by 5 May.</p>
<p>However, Steenhuisen maintained the allegations of delays were unfounded, emphasising that efforts are underway to vaccinate as many animals as possible, as quickly as possible.</p>
<p>In the meantime, Steenhuisen and Brazil’s Minister of Agriculture and Livestock André Carlos Alves de Paula signed a memorandum of intent and a comprehensive action plan to enhance cooperation between the two nations.</p>
<p>“Together, we are turning biosecurity into a bridge for trade, resilience and economic growth,” Steenhuisen said.</p>
<p><a href="https://www.tlu.co.za/en/" target="_blank" rel="noreferrer noopener">TLU SA</a> chair Bennie van Zyl said the FMD challenge remained a crisis.</p>
<p>“It’s sad that there has to be a court case to force the state to act against FMD,” he added. Van Zyl said this process could have been concluded in January if the state had not dragged its feet.</p>
<h3 id="h-crisis-could-have-ended-in-january-tlu-sa" class="wp-block-heading">Crisis could have ended in January – TLU SA</h3>
<p>“The sector feels more speed could be added to the process,” he added.</p>
<p>Southern Africa Agricultural Initiative (<a href="https://saai.org/en/" target="_blank" rel="noreferrer noopener">Saai</a>) board chair Theo de Jager said the organisation was disappointed the minister has not respected the deadlines set by the court to publish a Section 10 scheme for FMD, and has asked for a further extension.</p>
<p>De Jager added Saai, Sake Liga and Vrystaat Landbou had asked him in January about regulations, or international requirements to obtain the vaccine themselves.</p>
<p>“Steenhuisen refused to respond, expressing the fear farmers would use the vaccine as biological weapons against each other.”</p>
<p>After he and several agricultural leaders and academics, who are considered his confidants, made a big fuss about the World Organisation for Animal Health (WOIE) requiring strict central government control in the handling of vaccine.</p>
<p>“WOIE denied this and stated there is no obstacle,” De Jager added. This prompted them to seek court clarification, he said.</p>
<h3 id="h-saai-accuses-steenhuisen-of-ignoring-deadlines" class="wp-block-heading">Saai accuses Steenhuisen of ignoring deadlines</h3>
<p>“At the 11th-hour, the minister laid before the court a Section 10 scheme that would be published in the same week and would provide the clarity sought by the applicants,” De Jager said.</p>
<p>“The court granted him three weeks to do so and adjourned the case until 28 April.</p>
<p>“However, the minister requested a further adjournment without explaining why the previous deadlines had not been met.”</p>

										<content:encoded><![CDATA[<p>The Special Investigating Unit (SIU) has clawed back more than R1.7 billion in misallocated student funding, prompting a sweeping overhaul of NSFAS’s operations.</p>
<p>However, thousands of qualifying students remain locked out of universities and colleges despite meeting the admission requirements.</p>
<h2 id="h-siu-investigation-remains-ongoing" class="wp-block-heading">SIU investigation remains ongoing</h2>
<p>According to the Minister of Higher Education, Siviwe Gwarube, the SIU’s probe into the National Student Financial Aid Scheme, conducted under Proclamation R.88 of 2022, found that two structural weaknesses had enabled large-scale financial abuse.</p>
<p>These were a Solution Provider intermediary model that sat between NSFAS and the students it was meant to serve, and poorly governed memoranda of agreement with institutions.</p>
<p>Together, these created the conditions for overcharging and the exploitation of so-called ghost beds, accommodation that was billed for but never occupied.</p>
<p>Gwarube confirmed the scale of the response, noting that the findings had prompted sweeping institutional and operational changes.</p>
<h3 id="h-questions" class="wp-block-heading">Questions</h3>
<p>She was responding to a question posed by Imraan-Moosa, Al Jama-ah MP.</p>
<p>“The SIU investigation identified the Solution Provider intermediary model and weak MOA governance as the primary vectors for the R1.7 billion misallocation,” Gwarube said.</p>
<p>The most consequential reform has been the shift to a direct payment model. From 2026, NSFAS will disburse allowances and accommodation payments directly to students and accredited providers, cutting out the intermediary layer entirely.</p>
<p>The memoranda of agreement with all institutions have also been revised to include stronger reconciliation obligations, tighter verification of registration data, and explicit financial accountability provisions.</p>
<h3 id="h-changes" class="wp-block-heading">Changes</h3>
<p>At the governance level, the changes have been equally significant.</p>
<p>The former board was dissolved, and the former chief executive’s contract was terminated following findings in the Werksmans Report.</p>
<p>“A new board was appointed in March 2025 with a specific mandate to implement a turnaround strategy covering financial integrity and internal controls,” Gwarube said.</p>
<p>She added that the SIU investigation remains ongoing and that consequence management against implicated individuals and entities continues.</p>
<h3 id="h-thousands-of-students-turned-away-from-universities" class="wp-block-heading">Thousands of students turned away from universities</h3>
<p>Even as the funding system is being repaired, a separate crisis persists: qualified students – many holding bachelor’s passes and distinctions – are failing to secure places at universities or TVET colleges.</p>
<p>The minister acknowledged the severity of the situation directly.</p>
<p>“The placement challenge is real, and the Department does not minimise it,” Gwarube said.</p>
<p>“Demand for university places consistently exceeds available capacity, particularly at established urban institutions.”</p>
<h3 id="h-legislation" class="wp-block-heading">Legislation</h3>
<p>The government’s response is built around three parallel efforts.</p>
<p>Legislation for a national Central Application Service is expected to be tabled before Parliament in 2026, which is intended to improve placement coordination and close the information gaps that currently prevent qualified students from finding available spaces across the system.</p>
<p>Gwarube indicated that students who do not secure university placement are being actively directed to TVET colleges, where occupational and vocational programmes offer funded alternatives on the same basis as university study.</p>
<p>The longer-term answer, however, lies in physically expanding the system.</p>
<p>“The Ekurhuleni and Hammanskraal university establishment processes are advancing to expand system capacity in high-demand areas,” Gwarube said.</p>
<h3 id="h-private-universities-will-not-be-brought-into-the-nsfas-funding-net-for-now" class="wp-block-heading">Private universities will not be brought into the NSFAS funding net, for now</h3>
<p>A proposal to extend NSFAS funding to private higher education institutions – and potentially integrate private colleges into public university structures – has been ruled out under the current legislative framework.</p>
<p>The Higher Education Act of 1997 limits NSFAS funding strictly to students enrolled at public institutions, and Gwarube said there are no current plans to change that.</p>
