Shocking: ANC member asks court to jail Kubayi, Mbalula, Mabuyane
The High Court in KuGompo is expected to hear a contempt of court application filed by African National Congress (ANC) members this morning.
The application is against ANC Secretary General Fikile Mbalula, NEC convener of deployees in the province Mmamoloko Kubayi, Provincial Chairperson Oscar Mabuyane, and other National Executive Committee members deployed in the province.
The matter follows the party’s alleged failure to comply with an interim court order that interdicts the elective conference, which was scheduled for this weekend.
ANC members Lwazi Rotya, Sinethemba Mpande and Nompumelelo Mzotywa approached the court, arguing that the party did not follow its constitutional processes in preparing for the conference. They cited irregularities in branch verification and in Mbalula’s verification report.
The elective conference has since been suspended pending the outcome of disputes.
Despite the court ruling, the ANC has indicated its intention to appeal the interim order and proceed with the conference.
Legal analysts have argued that the nature of the ruling cannot be suspended until a final order is issued.
In their application, the aggrieved members have asked the court to find the respondents guilty of contempt and to sentence the first three respondents to 15 months imprisonment without the option of a fine, while the remaining respondents face financial penalties.
